I’ve known Cam a while now as he was the one who encouraged me to join the gym with my daughter in 2021, just after the 2021 lockdown. We were both a little nervous joining a gym, but with Cams support we were soon using the gym 3-4 times a week and joining circuit classes.

Both my daughter and I have literally gone from strength to strength and the effects are apparent both mentally and physically. We both started personal training with Cam, and this has taken our training to a whole different level – making us even more focussed and driven.

REAL BODIES HEALTH AND FITNESS

Real Bodies Health and Fitness is managed by Real Bodies Health and Fitness Ltd, 57 Hollands Road, Haverhill, Suffolk. CB9 8PJ

ACCEPTANCE OF MEMBERSHIP

The decision to accept the application of a potential member shall be at the sole discretion of Real Bodies Health and Fitness. Real Bodies Health and Fitness reserves the right to verify or require proof of all information given in order to obtain membership and any fraudulent or wrongful information given in order to obtain such membership could result in the cancellation of all membership rights and lead to the repayment of all monies due to Real Bodies Health and Fitness. If the membership application is accepted by Real Bodies Health and Fitness, membership of Real Bodies Health and Fitness by the applicant shall commence as stated on the agreement. Upon acceptance of the member by Real Bodies Health and Fitness, a membership card shall be issued by Real Bodies Health and Fitness. The membership card remains the property of Real Bodies Health and Fitness and entitles the holder to all the rights and privileges exercisable by the category of membership of the holder.

The acceptance of an application for membership of Real Bodies Health and Fitness shall constitute a legally binding agreement between the member and the Centre. The member hereby agrees also to be bound by the Club Rules, a copy of which can be provided by asking at Reception.

Signing in: All current members must sign in via fingerprint at Reception to gain membership rights every time a visit is made to Real Bodies Health and Fitness. Memberships may only be used by the registered member and any fraudulent use of the membership by the member could result in cancellation of the membership with no refund being made by Real Bodies Health and Fitness.

LIMITATION OF LIABILITY

The member acknowledges that Real Bodies Health and Fitness’s obligations and liabilities in respect of Real Bodies Health and Fitness are defined in this agreement and/or within the Regulations Applicable to All Users.

The member is responsible for the consequences of any use of any of the facilities of Real Bodies Health and Fitness. Real Bodies Health and Fitness will not be liable for any indirect or consequential loss, damage, costs, expenses, theft or damage to property, whether arising under contract, or otherwise.

PHYSICAL HEALTH OF MEMBER

The member warrants and represents that he/she is in good health and is not knowingly incapable of engaging in either active or passive exercise. The member further warrants that such exercise would not be detrimental to their health, safety, comfort, well-being or physical condition.

Before using Real Bodies Health and Fitness, the member must first complete a Gym Introduction pre-exercise questionnaire and unless otherwise agreed undergo an induction session

MEMBERSHIP

The categories of membership are Single and Family (all family members must be living at the same address. Proof of address is needed when signing up). All categories of membership shall be subject to these Terms and Conditions of Membership which are in force at the time.
A Family membership shall be available. Family memberships are available on condition that payment is made from one bank account jointly.
Other categories of membership shall be stipulated by Real Bodies Health and Fitness from time to time.

As a 24 hour secure access fitness facility, Real Bodies Health & Fitness Ltd

(Hereafter referred to as “Real Bodies Gym”), has a few different policies and procedures than a typical fitness facility.
Please read the information carefully; If you have any questions, please ask.

Membership price plans

All memberships are price reviewed on a regular basis to ensure effective business stability, any changes to your membership charges will be notified to you via email by the collection agent / company not Real Bodies Gym Ltd. (please ensure your contact email address is correct and notify us of any updates or changes).

Compliance with rules

I understand and agree that a 24/7 gym membership is a special membership based on trust and is a privilege, which can be taken away for a violation of rules. As a gym member, I agree to abide by all gym membership rules and 24/7 membership rules, which will be posted at the facility/website and may be amended from time to time at the sole discretion of Real Bodies Gym.

  • The additional rules below apply to a 24/7 membership:
    Mandatory Annual £28 fee for an Access Card/Fob for a 24/7 membership (replacement card/fob £15)
  • Only one 24/7 member may enter Real Bodies Gym front door at a time during non-staffed hours
  • Card/Fob sharing is strictly prohibited and will result in immediate loss of membership; card sharing is viewed by ownership as stealing services
  • Only active account members will be allowed entry
  • Pre-approved 24/7 members under the age of 18 must be accompanied by an approved member/ parent until they reach the age of 18
  • I agree that improper unauthorised use of the facility may result in member suspension or cancellation. I agree not to let anyone use my card for any reason, and I agree to report any situation that appears to be card/fob sharing to Real Bodies Gym staff. A security “tailgate” system has been installed to monitor and record instances of “tailgating”. I understand that one act of card/fob sharing will result in immediate membership suspension or termination. Real Bodies Gym reserves the right to suspend or cancel the rights, privileges, and membership of any member whose actions are detrimental to the use, safety, and enjoyment of the facilities.
  • Initial your acceptance to abide by Real Bodies Gym’s rules and 24/7 rules.

 

No Supervision

I understand that I am purchasing a membership at a 24/7 facility that allows access at any time. As such, I am aware that there will be no supervision or assistance except during staffed hours. Staffed hours may change at the sole discretion of Real Bodies Gym. I am aware that if I get injured, become unconscious, suffer a stroke, heart attack or any other medical emergency or event that there will likely be no one to respond to my emergency and that Real Bodies Gym has no duty to provide assistance to me while I am at Real Bodies Gym. I understand that even though Real Bodies Gym is equipped with surveillance cameras, these record, but are not monitored continuously; help will not be available during non-staffed hours. However, a first aid station, AED and emergency intercom are in the facility.

Emergency services can be called by the mobile phone you must have on your person and an emergency access fob can be used to unlock the front door to allow entry. (Use intercom for emergency fob access code)

Initial your acceptance of No Supervision

Acknowledgement of Risk and Waiver of Liability.

I voluntarily assume the risk of injury, accident, death, loss, cost or damage to my person or property which might arise from my use of Real Bodies Gym, and I agree to hold harmless and release Real Bodies Gym and all affiliated corporations, and its officers, directors, board members, agents, employees, representatives, executors, and all others from any and all liability. I also release all of those mentioned and any others acting on their behalf from any responsibility or liability for any injury or damage to myself including those caused by the negligent act or omission of any of those mentioned or others acting on their behalf or in any way arising out of or connected with my participation in any activities or the use of any equipment at Real Bodies Gym during staffed or non- staffed hours. Initial your acceptance of Acknowledgement of Risk and Release of Liability Waiver.

Informed Consent

General Statement of Program Objectives and Procedures I understand that a physical fitness program may include exercises to build the cardio-respiratory system (heart and lungs), the musculoskeletal system (muscle endurance, strength, and flexibility), and to improve body composition (decrease of body fat in individuals needing to lose fat, with an increase in muscle and bone). Exercise may include aerobic activities (treadmill walking/running, bicycle riding, rowing machine exercise, group aerobic activity and other such activities), calisthenics, and weightlifting to improve muscular strength and endurance, and flexibility exercises to improve joint range of motion.

Description of Potential Risks

I understand that the reaction of the heart, lung, and blood vessel system to such exercise cannot always be predicted with accuracy. I know there is a risk of certain abnormal changes occurring during exercise, which may include abnormalities of blood pressure or heart rate, in effect of functioning of the heart, and in rare instances heart attacks. Use of the weightlifting equipment, and engaging in heavy body calisthenics, can lead to musculoskeletal strains, pain, and injury if adequate warm-up, gradual progression, and safety procedures are not followed.

(PARQ) Physical Activity Readiness Questionnaire

Regular physical activity is fun and healthy, and increasingly more people are starting to become more active every day. Becoming more active is very safe for most people. However, some people should check with their Doctor before they start becoming much more physically active.

If you are planning to become much more physically active than you are now, start by answering the seven questions in the box below. If you are between the ages of 15 and 69, this questionnaire (the PARQ) will tell you if you should check with your Doctor before you start. If you are over 69 years of age and you are not used to being active, check with your Doctor.

Social Media Consent

I hereby give consent to Real Bodies Health & Fitness Ltd to photograph, videotape, or otherwise digitally record and use images and/or sound recordings of myself or my child or children (if applicable) to use in any public media, including radio, television, internet, social media platforms.

Please read the questions carefully and answer each one honestly. Check the box indicating yes or no.

Common sense is your best guide when you answer these questions.

  5. Do you have a bone or joint problem that could be made worse by a change in your physical activity?
  6. Is your Doctor presently prescribing drugs (for example, water pills) for your blood pressure or heart condition?
  7. Do you know any other reason that you should not do physical activity?

 

Cleared for Exercise

I certify that I am in good physical health and I am able to undertake and engage in the range of physical activities in which I choose to participate at Real Bodies Gym. I assume all responsibility for updating the facility with respect to any changes in my physical or mental condition and for reporting all injuries sustained at the facility to Real Bodies Gym staff. I understand and am aware that strength, flexibility, aerobic and anaerobic exercise, including the use of any equipment, is a potentially hazardous activity. I also understand that fitness activities involve a risk of injury and even death and that I am voluntarily participating in these activities and using equipment with knowledge of all the dangers involved.

I do hereby agree to expressly assume and accept any and all risks of injury or death either accidental or otherwise. This waiver, release and indemnification agreement includes, without limitation, all injuries which may occur as a result of
(a) my use of all amenities and equipment in the facility and my participation in any class, activity or personal training,
(b) sudden unforeseen malfunctioning of any equipment and
(c) my slipping or falling while in the facility, on the facility premises, including adjacent sidewalks and parking areas. I acknowledge that I have carefully read this waiver, release and indemnification agreement and fully understand that it is a full and complete release of all liability.

Duty to Inform of Changes in Health Condition

I understand that I am required to inform Real Bodies Gym of any material changes in my health condition in the future, including but not limited to, any changes which would cause me to change my responses to the PARQ above. General

This contract represents the complete understanding between you and Real Bodies Gym. No representations, written or oral, other than those contained in this contract are authorised or binding upon Real Bodies Gym. Should any part of this agreement due to legal or other regulatory changes become unenforceable, the remaining provisions within this agreement not impacted by such change shall remain in full force as originally written. You agree to promptly update Real Bodies Gym of any changes of address, phone, e-mail address and/or bank account/credit card information.

Other

Your mobile phone number and/or email address will be used to contact you as part of the GDPR consent requirements to manage your usage of Real Bodies Gym including reminders of classes and membership renewals (if relevant).
No use of the sunbed area during non-staffed hours.
Unauthorised areas are clearly marked and secured with motion sensors during non-staffed hours.

By entering / using Real Bodies Health and Fitness Ltd (Haverhill) and paying by direct debit or any means of payment made to Real Bodies Health and Fitness Ltd you agree to all parts of these terms and conditions.

I certify that I have read and understand all of the terms of Real Bodies Gym agreement and agree to continue to abide by all of the terms of this agreement.

A security “tailgate” system has been installed to monitor and record instances of “tailgating”. I understand that one act of card/fob sharing will result in immediate membership suspension or termination.

Real Bodies Gym reserves the right to suspend or cancel the rights, privileges, and membership of any member whose actions are detrimental to the use, safety, and enjoyment of the facilities.

No Supervision

I understand that I am purchasing a membership at a 24/7 facility that allows access at any time. As such, I am aware that there will be no supervision or assistance except during staffed hours. Staffed hours may change at the sole discretion of Real Bodies Gym. I am aware that if I get injured, become unconscious, suffer a stroke, heart attack or any other medical emergency or event that there will likely be no one to respond to my emergency and that Real Bodies Gym has no duty to provide assistance to me while I am at Real Bodies Gym. I understand that even though Real Bodies Gym is equipped with surveillance cameras, these record, but are not monitored continuously. Help will not be available during non-staffed hours. A first aid station, AED and emergency intercom are in the facility.

Emergency services can be called by the mobile phone you must have on your person and an emergency access fob can be used to unlock the front door to allow entry. (Use the intercom for emergency fob access code)

Acknowledgement of Risk and Waiver of Liability

I voluntarily assume the risk of injury, accident, death, loss, cost or damage to my person or property which might arise from my use of Real Bodies Gym, and I agree to hold harmless and release Real Bodies Gym and all affiliated corporations, and its officers, directors, board members, agents, employees, representatives, executors, and all others from any and all liability. I also release all of those mentioned, and any others acting on their behalf, from any responsibility or liability for any injury or damage to myself including those caused by the negligent act or omission of any of those mentioned or others acting on their behalf or in any way arising out of or connected with my participation in any activities or the use of any equipment at Real Bodies Gym during staffed or non-staffed hours.

Informed Consent

I understand that a physical fitness program may include exercises to build the cardio-respiratory system (heart and lungs), the musculoskeletal system (muscle endurance, strength, and flexibility), and to improve body composition (decrease of body fat in individuals needing to lose fat, with an increase in muscle and bone). Exercise may include aerobic activities (treadmill walking/running, bicycle riding, rowing machine exercise, group aerobic activity and other such activities), calisthenics, and weightlifting to improve muscular strength and endurance, and flexibility exercises to improve joint range of motion.

Description of Potential Risks

I understand that the reaction of the heart, lung, and blood vessel system to such exercise cannot always be predicted with accuracy. I know there is a risk of certain abnormal changes occurring during exercise, which may include abnormalities of blood pressure or heart rate, in effect of functioning of the heart, and in rare instances heart attacks. Use of the weightlifting equipment, and engaging in heavy body calisthenics, can lead to musculoskeletal strains, pain, and injury if adequate warm-up, gradual progression, and safety procedures are not followed.

(PARQ) Physical Activity Readiness Questionnaire

Regular physical activity is fun and healthy, and increasingly more people are starting to become more active every day. Becoming more active is very safe for most people. However, some people should check with their Doctor before they start becoming much more physically active.

If you are planning to become much more physically active than you are now, start by answering the seven questions in the box below. If you are between the ages of 15 and 69, this questionnaire (the PARQ) will tell you if you should check with your Doctor before you start. If you are over 69 years of age, and you are not used to being active, check with your Doctor.

Please read the questions below carefully and answer each one honestly before acknowledging this agreement at the bottom.

Common sense is your best guide when you answer these questions. If the answer is Yes to any of these questions, do NOT acknowledge this agreement but discuss first with a staff member of Real Bodies Gym and/or your Doctor.

  1. Has your Doctor ever said that you have a heart condition and that you should only do physical activity recommended by a Doctor?
  2. Do you feel pain in your chest when you do physical activity?
  3. In the past month, have you had pain in your chest while NOT doing physical activity?
  4. Do you lose your balance due to dizziness or do you ever lose consciousness?
  5. Do you have a bone or joint problem that could be made worse by a change in your physical activity?
  6. Is your Doctor presently prescribing drugs (for example, water pills) for your blood pressure or heart condition?
  7. Do you know any other reason that you should not do physical activity?


Cleared for Exercise

I certify that I am in good physical health and I am able to undertake and engage in the range of physical activities in which I choose to participate at Real Bodies Gym. I assume all responsibility for updating the facility with respect to any changes in my physical or mental condition and for reporting all injuries sustained at the facility to Real Bodies Gym staff. I understand and am aware that strength, flexibility, aerobic and anaerobic exercise, including the use of any equipment, is a potentially hazardous activity. I also understand that fitness activities involve a risk of injury, and even death, and that I am voluntarily participating in these activities and using equipment with knowledge of all the dangers involved.

I do hereby agree to expressly assume and accept any and all risks of injury or death either accidental or otherwise. This waiver, release and indemnification agreement includes, without limitation, all injuries which may occur as a result of

(a) my use of all amenities and equipment in the facility and my participation in any class, activity or personal training,

(b) sudden unforeseen malfunctioning of any equipment and

(c) my slipping or falling while in the facility, on the facility premises, including adjacent pavements/walkways and parking areas. I acknowledge that I have carefully read this waiver, release and indemnification agreement and fully understand that it is a full and complete release of all liability.

Duty to Inform of Changes in Health Condition

I understand that I am required to inform Real Bodies Gym of any material changes in my health condition in the future, including but not limited to, any changes which would cause me to change my responses to the PARQ above.

General

This contract represents the complete understanding between you and Real Bodies Gym. No representations, written or oral, other than those contained in this contract are authorized or binding upon Real Bodies Gym. Should any part of this agreement, due to legal or other regulatory changes become unenforceable, the remaining provisions within this agreement not impacted by such change shall remain in full force as originally written. This agreement is subject to the laws of England only.

You agree to promptly update Real Bodies Gym of any changes of address, phone, e-mail address and/or bank account/credit card information.

Other

No use of the showers/changing rooms & sunbed area is allowed during non-staffed hours.

Unauthorised areas are clearly marked and secured with motion sensors during non-staffed hours.

I certify that I have read and understand all of the terms of Real Bodies Gym agreement and agree to continue to abide by all of the terms of this agreement.
